RETURNS AND EXCHANGES
Article 9: Right of withdrawal, return and exchange
***Transport costs for the first exchange will be borne by Benson Shoes. The Customer has a period of seven (7) days to exercise their right of withdrawal from the date of receipt of the order. The Customer may request an exchange of all or part of the products in their order, subject to sending an email to the Company's customer service department on the day of delivery or at the latest on the first working day following delivery. Beyond this period, the Company will under no circumstances be able to process the exchange request.
The parcel must be returned within 7 days of receipt. Any claim made after this period will be rejected and the Company will be released from any liability. If the aforementioned conditions are met, the Company will then proceed with the exchange within a period of fifteen (15) days from the date of receipt of the parcel by the Company, depending on availability. This exchange may consist of I) an exchange of size, subject to the availability of the products on the date of the Customer's request, II) an exchange of color or item, subject to the availability of the products on the date of the Customer's request, III) the issuance of a credit note which may be used within a period of three (3) months from the date of purchase, outside of the sales period and before the following season, IV) a refund for the returned item. Items being exchanged must be returned in their original packaging and condition in perfect state to the address provided by the Company's customer service. Items must be returned in a new condition suitable for resale, i.e.:
- Unworn;
- Not soiled;
- Unwashed;
- Unbroken;
- Folded in their original packaging;
- Where applicable, with the security and identification tag still attached to the product(s).
The items must be accompanied by all their accessories and the return number provided by the Company. The costs and risks associated with returning the product are the responsibility of the Customer. If the product is lost by the carrier during this shipment, the Customer will be solely responsible and cannot be reimbursed by the Company. Consequently, it is their responsibility to keep all proof of this return. The Company suggests that the Customer return their products via registered mail or with additional insurance, guaranteeing them, if necessary, compensation for the products up to their actual market value in the event of theft or loss of the merchandise. In any case, the return is carried out at the Customer's own risk. It will be the customer's responsibility to keep all proof of return. Return costs are the responsibility of the customer, who is free to choose the shipping method.
As part of this right of exchange and for returned items that prove to be incomplete, damaged, soiled, or unsuitable for resale, the Company reserves the right to refuse to exchange the returned products.
Any parcel returned to the address provided by the Company's customer service that does not include any element allowing the Customer to be identified, in particular the return number, cannot be accepted under any circumstances. No claim from the Customer can be accepted.
If the aforementioned conditions are met, the Company will proceed with an exchange or the issuance of a credit note within a maximum of fifteen (15) days from the date of receipt of the parcel by the Company.
Items on promotion or sale are not exchanged.
After receipt of the exchange request and the products to be exchanged, the shipping times for replacement items are the same as for a standard order shipment. Credit notes obtained following a return must be used within a maximum period of 3 months from the date of purchase, outside of the sales period and before the following season.
In the event of an error attributable to the Company (defective items or order preparation error), the Company will cover the return costs of the item. The Customer must transmit the carrier's invoice to the Company to obtain reimbursement.
Returned items must be intact, in perfect condition for resale, and in their original packaging. They must not have been worn or used, nor have suffered any deterioration, however slight, and must be in a perfectly clean state. Any product that is damaged, incomplete, or whose original packaging is deteriorated will neither be refunded nor exchanged.
The Customer has a period of seven (7) days to exercise their right of withdrawal from the date of receipt of the order.
This right of withdrawal is exercised without penalty. In the event of exercising the right of withdrawal, the Customer will receive a credit note for the amounts paid to be used on a future order. The credit note is valid for 3 months and is available online in the customer's account. It can be combined with other promotions and sales.
For all conditions regarding the return of the order, fees, etc., the same conditions as above apply.

A fortuitous event or force majeure will be considered any irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, independent of the will of the parties, and which cannot be prevented by the latter, despite all reasonably possible efforts.
The party affected by such circumstances will notify the other within ten working days following the date on which they become aware of them. Both parties will then come together, within a period of one month, unless impossible due to the force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the case of force majeure lasts for more than two months, these general conditions may be terminated by the injured party.
Expressly, the following are considered cases of force majeure or fortuitous events:

- Interruption of telecommunication networks or difficulties specific to telecommunication networks external to the Customers.
